I CONFIRM BY MY SIGNATURE TO THIS APPLICATION THAT I HAVE NOTED THE UNDERTAKING, INDEMNITY, AND THE CONTENT OF THE PROTECTION OF PERSONAL INFORMATION ACT, 2013 (ACT NO. 4 OF 2013) (POPIA) BELOW, AND AGREE THERETO.

EK BEVESTIG DEUR MY ONDERTEKENING VAN HIERDIE AANSOEK DAT EK KENNIS GENEEM HET VAN DIE ONDERNEMING, VRYWARING, ASOOK DIE INHOUD VAN DIE WET OP DIE BESKERMING VAN PERSOONLIKE INLIGTING WET 2013 (WET NO 4 VAN 2013) (POPIA) HIERONDER, EN DAARTOE INSTEM.

I/We undertake:

• to promote the knowledge, protection and propagation of trees and the preservation of tree-dominated ecosystems as a contribution to effective environmental conservation and improvement in Southern Africa;
• to respect the Constitution and Regulations of the Dendrological Society of South Africa.

Ek/Ons onderneem:

• om na die beste van my/ons vermoë te help met die bevordering van die kennis, beskerming en aanplanting van bome en die behoud van boomoorheerste ekosisteme as ʼn bydrae tot doeltreffende omgewingsbewaring en verbetering in die state van Suider‐Afrika;
• om die Grondwet en Regulasies van die Dendrologiese Vereniging van Suid-Afrika te eerbiedig.

Indemnity

This indemnity forms an integral part of my application for membership and is inseparable therefrom.

I realise that branches of the Society from time to time organise and present excursions or other activities (hereafter jointly referred to as activities).

Regarding such activities:

• I confirm that I will take part therein entirely voluntarily and of my own free will.
• I realize that (whilst the presenter always takes reasonable care to ensure acceptable standards of safety), taking part in the activities as presented inherently bears a potential measure of risk and danger.
• I accordingly indemnify and hold harmless the presenter and organizer as well as the owner and/or occupier of the land upon which the activities are presented, against any liability of whatsoever kind arising from damage to or loss of property, injury to any person and/or loss of life resulting from the activities and/or any failure by anybody to exercise any duty of care either properly or at all.
• I confirm that I will take part in the activities entirely at my own risk and being aware of my right at any time to stand back and to refuse to take part or participate in any activity.
• I confirm that, to the extent that any of my minor children or guests invited by me may also take part in any activity, this indemnity also applies to their participation, without any reservation.
• I agree to follow and comply with all instructions and safety precautions conveyed to me by the presenter regarding the activities, and realize and agree that:
  • the presenter may preclude any participant from further taking part in any activities should any such instructions be disregarded.
  • to the extent that I may disregard such instructions or precautions, i shall have no recourse whatsoever in the event of any loss or damage.
• I agree that any person who is responsible for any malicious damage will be liable for the costs to replace or repair such damaged equipment.
• I agree and consent thereto that any dispute or claim arising from this indemnity or any activity will be determined and settled according to South African Law, by a South African court of competent jurisdiction.

Vrywaring

Hierdie vrywaring vorm ‘n integrale deel van my aansoek om lidmaatskap en is onafskeidbaar daarvan.

Ek verstaan dat takke van die Vereniging van tyd tot tyd uitstappies of ander aktiwiteite (hierna gesamentlik genoem aktiwiteite) organiseer en aanbied.

Met betrekking tot sodanige aktiwiteite:

• bevestig ek hiermee dat my deelname daaraan vrywillig en uit eie beweging sal wees.
• besef ek dat (hoewel die aanbieder altyd redelike voorsorg sal tref ten einde aanvaarbare veiligheidstandaarde te verseker), deelname aan die aktiwiteite nietemin ‘n inherente mate van risiko en gevaar kan inhou.
• vrywaar ek gevolglik die aanbieder en organiseerder asook die eienaar en/of okkupeerder van die grond waarop die aktiwiteite aangebied word, teen enige aanspreeklikheid van enige aard voortspruitend uit beskadiging of verlies van eiendom, besering aan enige persoon en/of lewensverlies voortspruitend uit die aktiwiteite en/of enige versuim deur enige persoon om enige voorsorgplig, hetsy algeheel of gedeeltelik, uit te oefen.
• bevestig ek dat ek aan die aktiwiteite sal deelneem op my uitsluitlike risiko, en terwyl ek terselfdertyd bewus is van my reg om te enige tyd van deelname te onttrek of om te enige tyd te verkies om enigsins of verder deel te neem aan enige bepaalde aktiwiteit.
• bevestig ek dat, tot die mate waartoe enige van my minderjarige kinders of gaste deur my uitgenooi ook aan enige aktiwiteit mag deelneem, hierdie vrywaring ook betrekking het op hulle deelname, sonder enige voorbehoud.
• stem ek in om alle aanwysings en voorsorgreëlings wat met betrekking tot enige aktiwiteit aan my gegee mag word deur die aanbieder te volg en daaraan te voldoen, en besef en kom ek ooreen dat:
  • die aanbieder enige deelnemer van verdere deelname mag belet by verontagsaming aan enige sodanige voorskrifte.
  • tot die mate waartoe enige sodanige aanwysings of voorsorgreëlings verontagsaam word, daar geen verhaalsreg hoegenaamd sal wees in die geval van enige verlies of skade nie.
• stem ek in dat enige persoon verantwoordelik vir opsetlike beskadiging van eiendom, verantwoordelik gehou sal word vir die herstel/vervanging daarvan.
• kom ek ooreen en stem daartoe in dat enige dispuut of eis wat uit hierdie vrywaring of deelname aan enige aktiwiteit mag voortspruit, besleg sal word volgens Suid-Afrikaanse Reg deur ‘n Suid-Afrikaanse hof van bevoegde jurisdiksie.

Privacy

The Society noted the content of the PROTECTION OF PERSONAL INFORMATION ACT, 2013 (ACT NO. 4 OF 2013) POPIA, and undertakes to comply with the regulations of the Act. As a result, the Society requires the following minimum information from existing and new members:

• The respective branch management needs a mobile phone number to invite the member to join a WhatsApp group to communicate information regarding excursions that are arranged and other relevant information about branch activities;
• The Society’s Administration as well as the branch management need an e-mail address to communicate with members on membership, membership fees and other relevant membership affairs such as:
  • the nearest town or city where the member resides to make correct branch allocations.
• The Society does not require a member’s postal address, residential address, bank details, identity numbers and marital/relationship status.
• All personal information, as defined in Section 1 of the Personal Information Protection Act, Act 4 of 2013 (‘POPIA’); received, collected, used, distributed, destroyed and/or processed; of any member, organization, provider, third party, service provider and/or data subject, will be processed in accordance with the terms of POPIA, and specifically in terms of the 8 conditions for the lawful processing of personal information.
• The Society refrains from disclosing, copying, distributing and/or using any member’s information in any way and/or form that is contrary to the conditions as defined in the Personal Information Protection Act 4 of 2013 (‘POPIA’).

Privaatheid

Die Vereniging neem kennis van die inhoud van die wet op die BESKERMING VAN PERSOONLIKE INLIGTING WET, 2013 (WET NO. 4 VAN 2013) POPIA, en onderneem om aan die regulasies van die wet te voldoen. As gevolg hiervan benodig die Vereniging die volgende minimum inligting van bestaande en nuwe lede:

• Die onderskeie takbesture benodig ’n selfoonnommer om die lid uit te nooi om by ’n WhatsApp groep in te skakel om inligting te kommunikeer met betrekking tot uitstappies wat gereël word en ander tersaaklike inligting oor takaktiwiteite.
• Die Vereniging se Administrasie asook die takbesture benodig ‘n E-posadres om met lede te kommunikeer oor lidmaatskap, ledegeld an ander tersaaklike ledesake soos:
  • die naaste dorp of stad waar die lid woonagtig is om korrekte takindelings te maak.
• Die Vereniging benodig nie ’n lid se posadres, woonadres, bankbesonderhede, identiteitsnommers en huwelik- verhoudingsstatus nie.
• Alle persoonlike inligting, soos omskryf in Afdeling 1 van die Wet op die Beskerming van Persoonlike Inligting, Wet 4 van 2013 (‘POPIA’); ontvang, versamel, gebruik, versprei, vernietig en/of verwerk; van enige lid, organisasie, verskaffer, derde party, diensverskaffer en/of data-onderwerp, sal verwerk word in ooreenstemming met die bepalings van POPIA, en spesifiek in terme van die 8 voorwaardes vir die wettige verwerking van persoonlike inligting.
• Die Vereniging weerhou haar daarvan om enige ledeinligting te openbaar, te kopieer, te versprei en/of te gebruik, op enige wyse en/of vorm wat teenstrydig is met die voorwaardes soos omskryf in die Wet op die Beskerming van Persoonlike Inligting Wet 4 van 2013 (‘POPIA’).
